Agreement to These Terms

These Terms of Use ("Terms") are a legally binding agreement between you ("you," "User") and 16TypeTalk ("we," "our," "us"), governing your access to and use of the 16TypeTalk mobile application and all related services (collectively, the "Service").

By downloading, installing, accessing, or using the Service, you confirm that:

• You are at least 13 years of age
• If between 13–17, you have obtained parental or guardian consent
• You have read, understood, and agree to be bound by these Terms
• You agree to our Privacy Policy, incorporated by reference

If you do not agree, you must not use the Service.

Description of the Service

16TypeTalk is an AI-powered personal reflection application presenting multiple MBTI-inspired personality perspectives ("the Council") in response to situations, decisions, or questions you share.

What 16TypeTalk IS

• A tool for self-reflection and perspective-taking
• An AI-powered discussion facilitator presenting diverse viewpoints
• A decision-support companion for personal, everyday decisions
• An entertainment and self-development application

What 16TypeTalk is NOT

• NOT medical advice, mental health treatment, or psychiatric care
• NOT a licensed therapist, psychologist, or counselor
• NOT a diagnostic tool for any health condition
• NOT a substitute for professional medical, legal, or financial advice
• NOT a crisis intervention service or emergency resource

Account Registration

Creating an Account

Full features require an account via Sign in with Apple or Google Sign-In. By creating an account, you represent that all information provided is accurate and current.

Account Security

• Maintain the confidentiality of your credentials
• You are responsible for all activity under your account
• Notify us at 16typestalk_app@proton.me if you suspect unauthorized access

Account Deletion

Delete your account at any time via Profile tab → Settings → Delete Account. Deletion is permanent and irreversible. Personal data is removed within 30 days per our Privacy Policy.

Acceptable Use Policy

Prohibited Actions

• Using the Service for any illegal purpose
• Submitting abusive, harassing, threatening, defamatory, or hateful content
• Impersonating any person or entity
• Infringing copyright, trademark, privacy, or other rights
• Attempting to jailbreak or bypass AI safety guidelines
• Reverse-engineering, decompiling, or disassembling the Service
• Using bots, scrapers, or automated tools to access the Service
• Introducing malware or harmful code
• Sharing account credentials with others

Consequences

We reserve the right to suspend or terminate your account without notice for violations and to report violations to appropriate authorities.

AI Consent and Third-Party Data Sharing

Our AI providers are contractually prohibited from using your data for any purpose beyond generating responses for us. See our Privacy Policy Section 5 for complete details.

Intellectual Property

Our IP

The Service — design, code, graphics, and underlying technology — is owned by 16TypeTalk and protected by applicable intellectual property laws.

Your License

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service on your personal device for personal, non-commercial purposes only.

MBTI Trademark

MBTI®, Myers-Briggs®, and Myers-Briggs Type Indicator® are registered trademarks of The Myers & Briggs Foundation, Inc. We are not affiliated with or endorsed by The Myers & Briggs Foundation. Our use of MBTI-inspired terminology is for entertainment and self-reflection purposes only.

Your Content

You retain full ownership of all prompts and content you submit ("User Content"). You grant us a limited, non-exclusive license to use, store, and process your User Content solely to provide the Service to you. We do not use your User Content for advertising or AI model training.

AI-Generated Content and Limitations

By using the Service, you acknowledge and agree that:

• AI-Generated Content is for informational and reflective purposes only
• AI-Generated Content may be inaccurate, incomplete, or inappropriate for your situation
• AI-Generated Content does not constitute professional advice of any kind
• You are solely responsible for all decisions you make
• The AI does not know you personally and only has access to what you share in the current session
• AI responses can reflect biases present in training data and should be viewed critically
• AI-generated quotes or attributions may not be accurate — verify before relying on them

Subscriptions and In-App Purchases

Free Features

16TypeTalk offers core features at no charge. We may modify the scope of free features at any time with reasonable notice.

Premium Subscriptions

• All pricing and terms will be clearly disclosed before any purchase
• Subscriptions auto-renew unless cancelled at least 24 hours before renewal
• Manage and cancel subscriptions through Apple App Store or Google Play settings
• Price changes communicated at least 30 days in advance

Billing and Refunds

All payments are processed by Apple App Store or Google Play. For Apple refunds: reportaproblem.apple.com. We do not have access to your payment card information.

Disclaimer of Warranties

Limitation of Liability

Our total aggregate liability for any claims shall not exceed the greater of: (a) the total amount you paid us in the twelve months preceding the claim, or (b) USD $100.

Indemnification

You agree to defend, indemnify, and hold harmless 16TypeTalk and its officers, directors, employees, and agents from and against any claims, damages, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

Governing Law and Dispute Resolution

Informal Resolution

Please contact us at 16typestalk_app@proton.me first. We have 30 days to try to resolve any dispute informally before formal proceedings.

Arbitration

Unresolved disputes will be settled through binding individual arbitration. You and we waive the right to participate in class action lawsuits to the fullest extent permitted by applicable law.

Exceptions

Either party may seek injunctive or equitable relief in court for intellectual property violations or emergency relief. Mandatory local consumer protection processes apply where required by law.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access immediately for violations of these Terms, legal requirements, or to protect other users. Sections 6, 7, 9, 10, 11, and 12 survive termination.

Changes to These Terms

• Material changes: in-app notification and/or email at least 14 days in advance
• Non-material clarifications: effective upon posting with updated Effective Date

Continued use after the effective date constitutes acceptance of the revised Terms.

Miscellaneous

• Entire Agreement: These Terms plus Privacy Policy constitute the entire agreement between you and us
• Severability: Invalid provisions are modified to minimum necessary; remaining provisions continue in force
• No Waiver: Our failure to enforce a right does not constitute a waiver
• Assignment: You may not assign rights without our written consent; we may assign without restriction
• Language: These Terms are written in English; English prevails in case of translation inconsistency
• Force Majeure: We are not liable for failures beyond our reasonable control
